1. Field of application

These General Conditions of Sale determine exclusively the contractual relationships between every user customer of the Embelleze website (hereinafter "User") and Brazilian Secrets Cosmetic Lda (hereinafter «Embelleze, New»).

The general conditions of sale are the only ones applicable and replace all other conditions except prior agreement, express and in writing. Embelleze may occasionally modify certain provisions of its general conditions, and it must also be reread to each visit on the Embelleze website (hereinafter referred to as the "Site"). We consider that when the order is validated, the customer is automatically accepting our general conditions of sale.

By connecting to the site, the client undertakes to comply with the General Conditions as well as the Conditions of Use. 

2. Orders on the Site

To place an order on the Embelleze website, simply access the website via the internet: www.embelleze.pt(24/24h and 7/7 days).

the embeleze.pt reserves the right to cancel or refuse an order from the customer with whom there is a dispute relating to the payment of a previous order.

The customer declares that he became aware and accepted these terms and conditions before completing his order.

3. Price

The sales prices indicated on the site are in Euros, with taxes included. Delivery fees are the customer's charge and are charged at the end of the order, depending on the selected products.

Embelleze reserves the right to modify prices at any time, however it will apply the rates in force that were indicated on the website at the time the customer made the order.

Please be advised that if the indicated price is incorrect and is manifestly derisory, regardless of its cause (computer bug, manual error, technical error, etc.), the order will be voided, even if it has already been confirmed.

4. Delivery modes

Products purchased on the Site are delivered in Mainland Portugal through the TIBA carrier.

In the delivery at home, in case of absence of the customer, the carrier will again attempt to deliver a second time. If you do not make it again, the product will be returned to our warehouses and the customer must repay the amount of the postage.

The shipping price will be calculated automatically according to the gross weight of the product and will be added at the end to the price of purchased products.

In case of non-receipt of the order within the indicated time limits, an investigation will be made with the carrier, and it may take a few days. The Customer must contact the Embelleze Customer Service and during this period no refund can be made, as it will have to be verified and confirmed the loss of the order.

The customer will have 48 hours after receiving the order to complain about any anomaly with the order through the ecommerce@embelleze.com
What to do at the time of delivery:
1. Check that the packaging is in perfect condition.
2. Check that the product complies with the order made and that it does not present visible defects.

The Embelleze.pt doesn't deliver in apart.

5. Delivery times

After making payment the delivery of the order will be shipped within 48 working hours. Delivery times are indicative and therefore to be considered valid when there are no physical or structural impediments (e.g.: incorrect addresses or force majeure setbacks).

6. Payment

Payments accepted by Embelleze areATM, Bank Transfer OrPaypal. 
The validation period of orders with payment in the ATM Network and bank transfer is 1 to 2 days and the customer has a period of up to 3 days to make payment. After this deadline the order is automatically cancelled.

7. Right of withdrawal

Embelleze only accepts returns for products that have not been opened and used. Products received incomplete, spoiled or used by the customer will not be accepted as return.

Under Directive 2011/EU on consumer rights, the consumer customer has a legal period of 14 days to exercise his right of withdrawal. This period is counted from the date of receipt of the product.

You do not need to provide any reason to exercise your right of withdrawal, you will not be penalized, provided that the product is in perfect condition and has not been used.

In the event of non-conformity or the retraction exercise, you may return the product, respecting the following modalities:

1- You may not make a return if there is clear evidence that the product has been used. Products must be returned properly protected in a perfect state of resale (not damaged, dirty or with traces of use by the customer), and accompanied by any accessories.

2-Also for hygiene reasons, and due to their nature, products may not be returned unless they have never been taken from the packaging and/or used, in order to allow for further marketing;

  • To exercise this retraction, you can send an email to ecommerce@embelleze.com, sending the Purchase Invoice, order number and batch of the product.
  • Please keep the proof of shipment of your return.
  • After sending the e-mail with the necessary documentation, you can return the product to Avenida da República, Nº 101, 3ºA, 1050-190 Lisbon - Portugal.

8. Refund

In case of return of the product, we will refund only the value of the product and not the value of the postage.

In the case of reimbursement of payments made via ATM, the period of return of the money will be longer, as it will depend on the bank and not directly from the company. The refund will be made by bank transfer through the IBAN registration.

In the event of a partial refund of a payment made using the discount coupon, it will be credited to the customer's account with priority in relation to the monetary amount.

9. Litigation and liability

For the resolution of any and all dispute stemming from the interpretation or enforcement of these General Conditions, the court of the Embelleze Headquarters shall be competent.
Embelleze is not responsible for delays or non-contractual compliance so reasons of force majeure, disruption, total or partial strike, postal services and means of transport or communication, flood, fire or war. Embelleze is not responsible for any indirect damage, loss of exploitation, loss of benefit, loss of opportunity, damage or fees that may arise from the purchase of any product presented on the website.

10. Protection of personal data

The information that the customer communicates on our Site is indispensable for the processing of the order, the establishment of invoices and without them, the order will be automatically cancelled. By writing on our Site, the customer undertakes to provide us with sincere and true information. The communication of false information is contrary to these general conditions, as well as to the conditions of use appearing on our Site.

Embelleze is the sole holder of the information concerning customers. Only Embelleze will be able to send information within the board of accurate and punctual promotional operations.

11. Intellectual Property

All content of the Embelleze Site (illustrations, texts, titles, marks, images, videos) is the property of Embelleze. Partial or total reproduction of the content through any procedure and on any medium is subject to prior and express authorization from Embelleze. All information, content, documents and software offered by our services are protected by Portuguese and international law with regard to intellectual property and copyright. Embelleze does not authorize the copying, presentation or distribution of the contents of which you do not have the right to intellectual property. Any fraudulent use of rights obtained by third parties constitutes a counterfeit ingms, severely sanctioned by the Intellectual Property Code. Embelleze will not be liable in any way for the violation of a user of rights obtained by third parties and perpetrated by the activities of the latter on the site.

12. Response Commitment

Embelleze is committed to responding to any request that the end customer submits within 48 working hours.
